Lessons, safety and responsibility

1.Fit to Drive

You agree that, at the commencement of each driving lesson, you are medically and physically fit and capable of driving safely.

This includes, but is not limited to:

  • Having zero (0.00%) alcohol and no illegal drugs in your system.
  • Not being affected by illness, injury or any medical condition that may impair your ability to drive safely.
  • Not experiencing drowsiness or impairment caused by medication.
  • Wearing glasses or contact lenses where required by law or as specified on your licence.

You must notify your instructor before the lesson if there is any condition, medication or other circumstance that may affect your ability to drive safely.

2.Current and Valid Driver's Licence

For every lesson, you must carry a current and valid Australian Driver's Licence (Class C) or a valid overseas driver's licence, where applicable. A physical or approved digital licence may be accepted.

A licence that is suspended, disqualified or expired is not considered valid or current.

If you hold an overseas driver's licence, you are responsible for contacting Service NSW to confirm that your licence is valid for driving in NSW and whether you are required to obtain a translation or other supporting documentation.

Failure to carry or produce a valid and current licence while driving may result in a fine or other penalty, which will be your responsibility.

3.Fines and Demerit Points

You are responsible for any fines, penalties or demerit points incurred while driving during a lesson.

Your instructor will make every reasonable effort to assist you in complying with NSW road rules and driving safely. However, you remain responsible for your actions as the driver and must exercise due care and responsibility at all times.

This applies whether you are driving with a professional instructor or another supervising driver.

4.Accidents and Incidents During a Lesson

Our training vehicles are covered by appropriate insurance, including comprehensive motor vehicle insurance, compulsory third-party insurance and public liability insurance, as applicable.

If an accident or incident occurs during a lesson and you are at fault, you will generally be covered subject to the terms, conditions and exclusions of the applicable insurance policy.

However, if an insurance investigation determines that the incident resulted from gross negligence, misconduct, unlawful behaviour, or driving while affected by drugs or alcohol, the insurer may refuse or limit a claim. Any relevant information may also be provided to the appropriate authorities, and you may be personally liable for resulting costs or damages.

5.Use of Your Own Vehicle

If you choose to use your own vehicle for driving lessons, you confirm that:

  • The vehicle is currently registered.
  • The vehicle is roadworthy and safe to operate.
  • The vehicle has appropriate comprehensive insurance coverage.
  • The vehicle complies with all applicable NSW legal requirements.

In the event of an accident or insurance claim involving your vehicle, you are responsible for any applicable insurance excess, repair costs or other expenses not covered by your insurer.

6.Right to Terminate a Lesson

The driving instructor reserves the right to refuse or terminate a lesson if they reasonably believe that continuing the lesson would be unsafe, inappropriate or detrimental to the learning environment.

Reasons may include, but are not limited to:

  • Gross negligence or misconduct.
  • Being medically or physically unfit to drive.
  • Being affected by alcohol, drugs or medication.
  • Repeatedly failing to follow reasonable instructions.
  • Aggressive, threatening or inappropriate behaviour.
  • Creating an unsafe or disruptive learning environment.

Where reasonably practicable, the instructor will explain the reason for terminating the lesson.

7.Test-Day Vehicle Hire

If you wish to book the use of a training vehicle for your driving test you must complete a two hour lesson with the instructor prior to the test day, the instructor reserves the right to cancel the vehicle hire if, on the day of the test, they reasonably determine that you are not sufficiently capable or proficient to safely operate the vehicle.

Students are strongly encouraged to complete lessons with the instructor before test day. This allows the instructor to assess your driving ability, familiarity with the vehicle and readiness for the driving test.

8.Driving Test Day Requirements

Students are responsible for ensuring that they meet all requirements for their driving test before attending the appointment.

For students using a NSW log book, the log book must be completed accurately and meet all applicable requirements before the test.

Students who hold an overseas driver's licence are responsible for bringing all required licences, identification and supporting documentation to the test.

Failure to provide the required documentation or meet the applicable testing requirements may result in the test being unable to proceed, and any associated costs will be the student's responsibility.

Booking, cancellation, payment terms

1.Booking Appointments

All driving lessons, vehicle hire and driving test bookings are subject to availability and must be booked in advance.

Bookings may be made by phone, text message, or email to Blue Driving School.

A booking is considered confirmed once the appointment has been accepted or confirmed by the driving school.

Students are responsible for providing accurate contact details and ensuring they are available at the agreed date and time.

2.Arrival and Punctuality

Students are expected to arrive on time and be ready to commence their lesson at the scheduled time.

Lessons commence and finish at the booked time. If a student arrives late, the lesson will generally still finish at the originally scheduled time, unless the instructor is able to extend the lesson without affecting subsequent bookings.

If the instructor is delayed due to unforeseen circumstances, every reasonable effort will be made to notify the student and minimise any impact on the lesson.

3.Cancellation and Rescheduling

We understand that circumstances can change. If you need to cancel or reschedule a lesson, 24 hours' notice is required.

Where the required notice is provided, the lesson may be rescheduled without a cancellation fee, subject to availability.

Cancellations or changes made with less than the required notice may result in the full lesson fee being charged.

Failure to attend a scheduled lesson without providing notice (a “no-show”) may result in the full lesson fee being charged.

4.Cancellation Due to Illness or Other Unforeseen Circumstances

If you are unwell or otherwise unable to safely participate in a driving lesson, you should contact the driving school as soon as possible.

If a student is unfit to drive due to illness, medication, alcohol, drugs, fatigue or any other condition that may affect safe driving, the instructor may cancel or terminate the lesson.

Where possible, the instructor will work with the student to reschedule the lesson.

5.Payment

Payment is required at commencement of the lesson or at the time of booking, unless otherwise agreed with the driving school.

Accepted payment methods may include Bank Transfer, PayID or cash.

All prices are quoted in Australian dollars and are subject to change. The price applicable to a confirmed booking will generally be the price agreed at the time of booking.
